Terms of Service — ActivitySafe

These Terms of Service (“Terms”) govern your use of the ActivitySafe mobile app (“the App”), operated by Kaloyan Todorov Peychev (“we”, “us”). By creating an account or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 13 years old to use the App. If you are between 13 and the age of majority in your country (18 in most jurisdictions), you may only use the App with the consent and under the supervision of a parent or legal guardian, who agrees to these Terms on your behalf and remains responsible for your use of the App.

Children under 13 may not create or hold their own account. A parent or legal guardian may, however, create and manage an account and use the App to track a child under their direct supervision (for example, a parent following a child's ride). The parent or guardian is the account holder and is responsible for all activity under that account.

2. What ActivitySafe does

ActivitySafe is an activity location-sharing and safety aid. It can:

• Track your location live during an activity and show your safety status and elapsed time.
• Let people you invite watch your live location during a shared/group session.
• In its cycling safety mode (“CyclistGuard”), broadcast your active ride to public-safety map feeds (such as Waze and Google Maps) to increase your visibility to nearby drivers.

3. Safety disclaimer — read this carefully

ActivitySafe is an assistive tool, not a safety guarantee.

• The App is not a substitute for attentive, lawful cycling, situational awareness, protective equipment, or compliance with all applicable traffic laws.
• Safety alerts and your visibility on third-party maps may be delayed, inaccurate, incomplete, or unavailable, including due to GPS error, network conditions, device battery/permission state, the App being closed, force-stopped, or removed from memory, battery depletion or the operating system stopping the tracking service, or the behavior of third-party map providers. Tracking runs only while the App's ride session is active — if you close or force-stop the App, tracking and broadcasting stop.
• We do not control whether or how third-party services (e.g. Waze, Google Maps) display, prioritize, or act on any information we send, and we make no guarantee that any driver will see, receive, or react to an alert.
• The App is not an emergency service. In an emergency, contact local emergency services directly. Do not rely on ActivitySafe to summon help.

You remain solely responsible for your own safety and conduct while cycling.

4. Your account and acceptable use

• You are responsible for activity under your account and for keeping access to your sign-in email secure.
• You agree not to misuse the App, interfere with its operation, attempt to access it in unauthorized ways, or use it for any unlawful purpose.
• You agree not to use the App to track or surveil any person without their knowledge and consent.

5. Third-party services

The App relies on third-party services (including Google Firebase, and public map feeds such as Waze and Google Maps). Your use of those services may also be subject to their own terms. We are not responsible for third-party services, their availability, or their content.

6. No warranty

The App is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including but not limited to fitness for a particular purpose, accuracy, reliability, or uninterrupted availability, to the maximum extent permitted by applicable law.

7. Limitation of liability

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, injury, or damage arising out of or in connection with your use of (or inability to use) the App, including reliance on any safety alert, location data, or third-party map behavior. Nothing in these Terms excludes liability that cannot be excluded under applicable law (including liability for death or personal injury caused by our gross negligence or intent).

8. Termination

You may stop using the App and delete your account at any time (Profile → Delete Account). We may suspend or terminate access if you breach these Terms or if required for security, legal, or operational reasons.

9. Changes to these Terms

We may update these Terms as the App evolves. Material changes will be reflected by an updated “Last updated” date. Continued use after changes means you accept the updated Terms.

10. Governing law

These Terms are governed by the laws of the Republic of Bulgaria, and, where applicable, mandatory EU consumer-protection law. Disputes are subject to the competent courts of Bulgaria, without prejudice to any mandatory consumer rights you have in your country of residence.
