Terms of Service — ActivitySafe

These Terms of Service (“Terms”) govern your use of the ActivitySafe mobile app (“the App”), operated by Kaloyan Todorov Peychev (“we”, “us”), a natural person, an individual sole IT developer, citizen of Bulgaria, address: Maystor Pavel ot Krimin 3 str, 1618, Sofia, Bulgaria.

The App is a real-time activity location-sharing and safety smartphone app for hiking, cycling, running and other outdoor activities. It tracks your live location during a session so it can optionally let people you invite watch your activity live.

By creating an account or using the App, you agree to these Terms that govern your use of the App. If you do not agree, you shall not use the App.

1. What ActivitySafe Does

ActivitySafe is an activity location-sharing and can be used as an assistive tool. It can:

• Track your location live during an activity, show your last known location and current activity elapsed time.
• Let people you invite watch your live location during a shared/group session.
• ActivitySafe displays your current activity location on a preloaded map provided by the third party service of Open Street Maps.

2. Eligibility

You must be at least 16 years old to use the App. If you are between 16 and the age of majority in your country (18 in most jurisdictions), you may only use the App with the consent and under the supervision of a parent or legal guardian, who agrees to these Terms on your behalf and remains responsible for your use of the App.

Anybody under 16 may not create or hold their own account.

A parent or legal guardian may create and manage an account and use the App to track his/her child under their direct supervision (for example, a parent following a child's ride). In that case the parent or guardian is the account holder and data controller contact for that account, who consents to the App’s Privacy Policy and contractual terms (Terms of Service) on behalf of the user below the age of 16 years, and is responsible for all activity under that account.

By using the App, you confirm that you meet the age requirements and/or that you have the necessary consents and rights.

3. Safety Disclaimer — read this carefully

ActivitySafe is an assistive tool, not a safety guarantee.

The App is not a substitute for attentive, lawful activity, situational awareness, protective equipment, or compliance with all applicable laws, including traffic laws.

Safety alerts and your visibility on third-party maps may be delayed, inaccurate, incomplete, or unavailable, including due to GPS error, network conditions, device battery/permission state, the App being closed, force-stopped, or removed from memory, battery depletion or the operating system stopping the tracking service, or the behaviour of third-party map providers.

Tracking runs only while the App's ride session is active — if you close or force-stop the App, tracking and broadcasting shall stop.

We do not control whether or how third-party services (Open Street Maps) display, prioritize, or act on any information we send, and we cannot guarantee that other members to your shared/group session will see, receive, or react to your current location sharing. The App is not an emergency service. In an emergency, contact local emergency services directly. Do not rely on ActivitySafe to summon help.

You remain solely responsible for your own safety and conduct.

4. Contract, Account, Acceptable Use, User Responsibility

Contract, Account

• The contract regarding the use of the App is concluded once you successfully verify your account via a link sent to your e-mail. By completing this verification step, you acknowledge the binding nature of these Terms, as amended from time to time and agree to adhere to them.
• You must first create a user account via the App, to use the App.
• To create a user account, you are ONLY required to provide your valid e-mail. You can use a Nickname while using the App.

User Responsibility

• You are responsible for the activity under your account and for keeping access to your sign-in email secure.
• Account security is your responsibility, including safeguarding your login credentials (your email address) and managing all actions performed through your account. If you suspect an account compromise, you are required to notify us immediately and take actions to secure your account.
• You must immediately notify us of any unauthorized account activity or security breaches. We cannot be held liable for any loss or damage resulting from the unauthorized use of your account.
• You shall ensure that your mobile device is functional and has access to the internet and complies with the technical requirements for using the App. The related costs, such as internet access, mobile data charges, power, etc. are users’ responsibility.

Acceptable Use

• Subject to these Terms, we grant the User a limited, non-exclusive, non-transferable, and revocable right to install and use the App on their personal device.
• You agree not to misuse the App, interfere with its operation, attempt to access it in unauthorized ways, or use it for any unlawful purpose.
• You agree not to use the App to track or surveil any person without their knowledge and consent.
• When using the App, you agree not to engage in activities that may harm the app, other users, or third parties. Such activities include, but are not limited to:
  • Using the App for any unlawful purpose or in violation of any applicable laws, statutes, ordinances, or regulations.
  • Engaging in any behaviour that constitutes harassment, abuse, defamation, stalking, threatening, or any other form of harm toward users or third parties.
  • Engaging in any attempt to circumvent security measures to gain unauthorized access to the App’s infrastructure or any other user account.
  • Engaging in identity theft, impersonating any individual or entity, or otherwise providing false or misleading information regarding your identity or affiliations.
  • Uploading, transmitting, or distributing viruses, malware, or any other malicious or harmful software.
• Downloading and using the App’s is free of charge. However, the App use may be subject to payment in the future. If introduced, the payment terms and applicable subscription fees will be notified in advance.

5. Third-party services

The App may and relies on third-party services (Google Firebase, Hetzner Cloud, EU Open Street Maps), such as maps, geolocation data, or cloud storage. We are not responsible for third-party services, their availability, accuracy, quality, reliability or their content, disruptions, errors, or limitations. Third-party services used within or alongside the App are governed by their own terms and policies. We are not responsible or liable for any third-party services, data processing, or content. It is your sole responsibility to review the applicable terms and policies of such third-party services.

6. No warranty

The App is provided “as-is” and “as available”, without warranties of any kind, whether express or implied, including but not limited to fitness for a particular purpose, accuracy, reliability, or uninterrupted availability, to the maximum extent permitted by applicable law. We do not guarantee that the App will meet your requirements or that it will be error-free, secure, or continuously available.

7. Disclaimers

• While we strive to offer a reliable and high-quality experience, we cannot guarantee that the App will always be available without interruption. The App relies on third-party services like internet providers, mobile networks, and map platforms. We are not responsible for any delays, disruptions, or failures caused by these external factors, maintenance, or unexpected technical issues. We reserve the right to temporarily pause services for updates or maintenance without prior notice. Nevertheless, we will make reasonable efforts to inform Users in advance of scheduled maintenance or updates that may significantly impact service availability.
• Location data provided by the App is subject to inherent technical limitations, including but not limited to device performance, network availability, GPS precision, and environmental disruptions (e.g., structures, atmospheric conditions, terrain). Consequently, we do not warrant the accuracy, timeliness, or completeness of the location information. You agree that location results may be delayed, inaccurate, or lost, and we expressly disclaim all liability for any damages arising from such inaccuracies.

We expressly disclaim any liability regarding the accuracy, completeness, or timeliness of information transmitted through the App (e.g., group members' location data). The App functions solely as a supportive aid and cannot prevent emergencies. Users should not rely on it as a guaranteed safety device.

8. Limitation of liability

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, injury, or damage arising out of or in connection with your use of (or inability to use) the App, including reliance on location data, or third-party map behaviour. Nothing in these Terms excludes liability that cannot be excluded under applicable law.

If we temporarily or permanently discontinue the App services, in whole or in part, this will not give rise to any liability on our part.

9. Termination

You may stop using the App and delete your account at any time (Profile → Delete Account). That way you withdraw from the contract to use the App. We may suspend or terminate access if you breach these Terms or if required for security, legal, or operational reasons.

10. Miscellaneous

10.1. Personal Data

Data processing within the App is regulated by the ActivitySafe Privacy Policy (Privacy Policy). By using the App, you accept that any personal data collected or processed will be handled in accordance with the Privacy Policy — ActivitySafe. (Privacy Policy)

10.2. Intellectual Property

All rights, title, and interest in and to the App, including its software, logos, design, and materials, remain solely with us. This property is protected under EU, Bulgarian, and international copyright and trademark laws. These Terms do not grant or transfer any intellectual property rights to the user.

10.3. Changes to these Terms

We may change these Terms from time to time. Material changes will be reflected by an updated “Last updated” date. Continued use after changes shall mean that you accept the updated Terms.

10.4. Transfer of Rights and Obligations

We reserve the right to transfer our rights and obligations under these Terms to third parties without your prior consent. You are not permitted to transfer your rights or obligations to any third party.

10.5. Severability

If any provision of these Terms is determined to be invalid or unenforceable by a court of competent jurisdiction, such determination shall not affect the validity of the remaining provisions. The unenforceable provision shall be amended to the minimum extent necessary to make it valid and enforceable while preserving its original intent.

10.6. Governing law

These Terms are governed by the laws of the Republic of Bulgaria and EU. Disputes are subject to the competent courts of Bulgaria.
